CLAY QUEST ENROLLMENT AGREEMENT, ASSUMPTION OF RISK & LIABILITY WAIVER
By enrolling a child in a Clay Quest class, workshop, camp, event, or program ("Program"), you ("Parent/Guardian") acknowledge that you have read, understood, and agree to the following terms on behalf of yourself and the enrolled child ("Participant").
1. PROGRAM PARTICIPATION
Clay Quest is a creative educational program that combines storytelling, world-building, character design, tabletop gaming, and hands-on clay sculpting.
Activities may include clay sculpting, ceramic tools and equipment, paints, glazes and art materials, tabletop games, collaborative projects, and kiln-fired artwork.
Clay Quest may conduct programs independently or in partnership with studios, schools, museums, libraries, community organizations, or other host venues.
2. ASSUMPTION OF RISK
Parent/Guardian understands that participation in art, ceramics, and classroom activities involves inherent risks, including but not limited to:
• Minor cuts, scrapes, pinches, and abrasions
• Exposure to clay, glazes, paints, and art materials
• Allergic reactions or sensitivities to materials
• Slips, trips, falls, or accidental collisions
• Damage to personal belongings
• Risks associated with participation in group activities
Parent/Guardian knowingly and voluntarily assumes all risks associated with participation in Clay Quest programs.
3. RELEASE OF LIABILITY
To the fullest extent permitted by law, Parent/Guardian releases and holds harmless Clay Quest LLC, its owners, instructors, employees, contractors, volunteers, host venues, property owners, partner organizations, sponsoring organizations, and affiliated parties from any claims, liabilities, damages, losses, costs, or expenses arising from participation in Clay Quest activities, except in cases of gross negligence or willful misconduct.
4. MEDICAL AUTHORIZATION
Parent/Guardian certifies that the Participant is physically able to participate in program activities.
In the event of an emergency, Parent/Guardian authorizes Clay Quest staff to obtain reasonable emergency medical care for the Participant when a Parent/Guardian cannot be reached.
Parent/Guardian accepts responsibility for any resulting medical expenses.
5. MEDICAL CONDITIONS & ALLERGIES
Parent/Guardian agrees to disclose any relevant medical conditions, allergies, behavioral concerns, learning accommodations, or special needs during enrollment.
Failure to disclose information necessary for safe participation may result in removal from the program without refund.
6. PARTICIPANT CONDUCT
Clay Quest is committed to providing a safe, respectful, and inclusive environment.
Participants are expected to:
• Follow instructor directions
• Respect fellow students, instructors, and facilities
• Use materials and tools appropriately
• Participate safely and respectfully
Clay Quest reserves the right to remove any participant whose behavior creates a safety concern or significantly disrupts the experience of others. No refund will be provided in such cases.
7. ATTENDANCE, DROP-OFF & PICK-UP
Parent/Guardian is responsible for:
• Timely arrival and pick-up
• Providing accurate emergency contact information
• Providing accurate authorized pick-up information
Clay Quest supervision begins at the scheduled start time and ends at the scheduled conclusion of the class.
Late pick-up may result in additional fees.
8. ARTWORK & KILN FIRING
Clay is a natural material and ceramic firing involves inherent risks.
Parent/Guardian understands that artwork may crack, break, warp, discolor, or otherwise change during drying, glazing, firing, transportation, or handling.
Clay Quest cannot guarantee the success of any individual ceramic piece and is not responsible for damage occurring during these processes.
Clay Quest also makes no guarantee regarding artistic outcomes, appearance, or quality of completed artwork.
9. PERSONAL PROPERTY
Clay Quest is not responsible for lost, stolen, or damaged personal property.
Participants are encouraged to leave valuables at home.
10. REFUND & CANCELLATION POLICY
Unless otherwise stated:
• Enrollment fees are non-refundable once a program begins
• Missed classes are not eligible for refunds or make-up sessions
• Clay Quest reserves the right to cancel or reschedule programs due to illness, weather, low enrollment, facility issues, or circumstances beyond its control
If Clay Quest cancels a program, a refund or credit may be issued.
11. PHOTOGRAPHY & MEDIA RELEASE
If Parent/Guardian opts in during registration, Clay Quest may photograph or record the Participant and/or their artwork for educational, promotional, social media, website, or marketing purposes.
Clay Quest may also photograph artwork created during programs for promotional purposes, even when children are not photographed or identified.
Participants will not be identified by full name without additional written permission.
Participation in the media release is optional and is not required for enrollment.
12. INTELLECTUAL PROPERTY
All Clay Quest curriculum materials, lesson plans, game systems, branding, program names, instructor-created artwork, and educational content remain the intellectual property of Clay Quest LLC.
Participants retain ownership of their own artwork.
13. HOST VENUES
Clay Quest programs may be conducted at facilities owned and operated by third parties, including studios, schools, museums, libraries, community centers, and other host venues.
Parent/Guardian acknowledges that these facilities are providing space for Clay Quest programming and agrees that the owners, operators, employees, volunteers, representatives, and affiliated organizations of such facilities shall be included among the released parties under this Agreement.
To the fullest extent permitted by law, Parent/Guardian releases and holds harmless such host venues and affiliated organizations from claims, liabilities, damages, losses, costs, or expenses arising from participation in Clay Quest activities, except in cases of gross negligence or willful misconduct.
14. GOVERNING LAW
This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania.
15. AGREEMENT
By checking the required agreement box during registration and completing enrollment, Parent/Guardian acknowledges that they have read, understood, and voluntarily agree to this Enrollment Agreement, Assumption of Risk, and Liability Waiver on behalf of themselves and the Participant.
